The purpose of this Privacy Policy is to provide the natural person – a client of BeeTech Services with information on the purpose, scope, protection, processing time and data subject's rights of processing personal data during the acquisition of data, as well as processing customer personal data.

Personal data processing manager is limited liability company "BeeTech Services" (hereinafter - BeeTech Services), Registration No. 40203063034 , legal address "Teili", Sigulda parish, Sigulda region, LV-2151, Latvia.

Scope of application of the document

Personal data is any information about an identified or identifiable natural person. Personal data definitions, explanations and data categories are listed in the relevant section of this document .

The privacy policy applies to the protection of privacy and personal data in relation to:

• natural persons - customers, subscribers and other users of services provided by BeeTech Services (including potential, past and present) as well as third parties in the context of the provision of services for a natural person (the subscriber, customer, user), which receive from or transfer to BeeTech Services any information, including, contact persons, payers etc. (hereinafter - Clients) ;
• users of the BeeTech Services internet website (www.beeking.eu) and web/mobile application “BeeKing” provided and operated by BeeTech Services (hereinafter - Clients).

BeeTech Services take care of the privacy of the Client and the protection of personal data, observe the Client's right to the lawfulness of the processing of personal data in accordance with applicable law - Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the following the free movement of data (Regulation) and other applicable law on privacy and data processing.

Privacy policy is applicable to the processing of data, regardless of the form and/or channels in which the Client provides personal data (BeeTech Services websites, web app, mobile app, in paper form or by telephone) and in which systems of the company's they are processed.

For specific types of data processing (such as cookie processing, etc.) additional, specific rules may be set for the purposes for which the Client is notified at the time he provides the relevant data to BeeTech Services .

The purpose of personal data processing

BeeTech Services processes personal data for the following purposes:

• For the provision of services:
  • Client identification;
  • provision of services;
  • the provision / maintenance of services;
  • improvement of services, development of new services;
  • promotion, advertising and distribution of the services;
  • customer service;
  • applications and complaints for processing and processing;
  • customer retention, loyalty, satisfaction measurement;
  • billing administration;
  • maintaining and improving performance of websites and and mobile apps.
• Business Planning and Analysis:
  • statistics and business analysis;
  • planning and accounting;
  • measuring efficiency;
  • data quality assurance;
  • market and public opinion research;
  • report preparation;
  • customer surveys;
  • risk management activities.
• Providing security of information, information systems and BeeTech Services.
• Providing information to the state administration institutions and the operative entities in cases and in the extent specified in external regulatory documents.
• For other specific purposes for which the Client is notified at the time when he/she provides the relevant data to BeeTech Services .

Legal basis for the processing of personal data

BeeTech Services processes Client's personal data based on the following legal grounds:

• to provide services at the Client's request;
• execution of regulatory enactments - in order to fulfill certain obligations bound by external regulatory enactments binding for BeeTech Services ;
• in accordance with the consent of the Client - the data subject;
• in the legitimate interest - in order to realize the legitimate interests of BeeTech Services and the Client arising from contracts between them;
• to enter into a contract between a Client and BeeTech Services and performance of contractual obligations;
• the vital interests of the data subject or other natural persons - to ensure the physical and property security of the people employed by BeeTech Services, customers and visitors.

The legitimate interests of BeeTech Services are:

• to carry out commercial activities;
• to eliminate unreasonable financial risks for their business (including, credit risk assessment before sale of services and during performance of the contract);
• to keep the Client's applications for the provision of services, other applications and submissions, notes about them, including those made in writing on websites;
• to analyze the operation of BeeTech Services websites and mobile applications, to develop and implement their improvements;
• to administer the Client's account on BeeTech Services websites and mobile applications;
• to take actions for keeping the customers;
• to segment customer database for more efficient provision of services;
• design and development of services;
• to advertise their goods and services;
• to conduct customer surveys about the services and their use;
• to prevent fraud;
• to provide corporate governance, financial and business accounting and analysis;
• to provide effective corporate governance processes;
• to ensure the efficiency of service provision;
• to ensure and improve the quality of services;
• to apply to state administrative and operational authorities and courts for the protection of their legal interests;
• to inform the public about its activities.

The processing of data necessary for entering into a service contract and the performance of contractual obligations is:

• checking the Client's identity before entering into a contract;
• data required for fulfilment of contractual obligations;
• payment administration;
• administration of late payments;
• informing Clients on the progress of the contract and essential events for the execution of the contract .

Processing of personal data

BeeTech Services processes Client data using current technology capabilities, taking into account existing privacy risks and reasonably available organizational, financial and technical resources available to BeeTech Services .

BeeTech Services can make automated decision-making for the Client. The Client shall be informed about such activities of BeeTech Services separately in accordance with regulatory enactments. The Client may object to automated decision making in accordance with the law, however must be aware that in certain cases it may limit the Client's right to use the individual options potentially available to him (for example, to receive commercial offers).

Acceptance of automated decisions that create legal consequences for the Client (for example, confirmation or rejection of the Client's application) may be performed only in the course of the conclusion or execution of a contract between BeeTech Services and the Client, on the basis of explicit consent of the Client or in cases specified in external regulatory enactments.

BeeTech Services may authorize its partners to perform separate service provision activities, such as payment processing, billing, and the like. When performing these tasks the partners which handle the Client's personal data at the disposal of BeeTech Services are considered to be BeeTech Services’ data controllers (operators) and BeeTech Services have the right to provide them with Client's personal data to the extent necessary to carry out these activities.

The BeeTech Services partner (in the status of the controller) will ensure the fulfilment of the requirements for the processing and protection of personal data in accordance with the requirements of BeeTech Services and relevant laws and will not use personal data for any other purpose, except for the fulfilment of the obligations of the contract concluded with the Client on behalf of BeeTech Services.

Personal data protection

BeeTech Services protects the Client's data using modern technological capabilities, taking into account existing privacy risks and reasonable organizational, financial and technical resources available to BeeTech Services, including the following security measures:

• encryption of transmitted data (SSL encryption);
• firewall;
• intrusion protection and detection programs;
• other protection measures in accordance with current technical development possibilities.

Categories of recipients of personal data

BeeTech Services do not disclose to third parties the Client's personal data or any information obtained from the provision of services and during the term of the contract, including information about services received, except:

• if the third party concerned has to transfer the data within the framework of a contract, in order to perform any function required for performance of the contract or delegated by law (for example, information required by a bank to process payments);
• in accordance with the Client's explicit consent;
• third parties upon their reasonable request, only in cases and in accordance with procedures specified in external regulatory enactments;
• in the cases prescribed by law, to protect the legitimate interests of BeeTech Services, for example by appealing to a court or other public authority against a person who has violated the legitimate interests of this BeeTech Services.

Access to personal data by entities outside of EU/EEA

In individual cases and in accordance with the requirements of regulatory enactments, entities from third countries (that is, countries outside the European Union and the European Economic Area) may access Clients’ data as data controllers (operators) in order to provide services required for fulfilment of contracts between BeeTech Services and Clients.

In such cases, BeeTech Services ensures the procedures specified in the regulatory enactments for ensuring the level of processing and protection of personal data equivalent to the one established by the Regulation .

Duration of personal data storage

BeeTech Services stores and processes Client's personal data as long as there exist at least one of these criteria:

• the contract with the Client is in force;
• the data is necessary for the purpose for which they were received;
• BeeTech Services or the Client can exercise their legitimate interests in accordance with the procedures prescribed by external regulatory enactments (for example, to submit objections or to bring an action in court);
• one of the parties has a legal obligation to store the data (for example, in accordance with the Accounting Law, invoices issued to the company must be kept for 5 years, etc.);
• the Client agrees to the relevant processing of personal data, if there is no other legal basis for the processing of the data.

After the circumstances referred to in this paragraph expire, the Client's personal data is deleted. Audit notes are stored not more than one year after the entry into force, unless otherwise specified by law or by the nature of the processing .

Access to personal data and other Client's rights

The Client has the right to receive information specified in regulatory enactments regarding the processing of his data. Most Client Information has already been placed on the BeeTech Services websites and applications that the Client uses to receive BeeTech Services services, and where the Client can verify the accuracy of their data and, if necessary, change it.

The Client in accordance with the laws and regulations also have the right to request BeeTech Services access to their personal data as well as request BeeTech Services to carry out the supplementation, correction or deletion of, or processing limitation with respect to the Client, or right to object to the processing (including the processing of personal data, which is done on the basis of the legitimate interests of BeeTech Services), as well as the right to data portability. This right is enforceable in so far as the processing does not result from the obligations of BeeTech Services which are imposed on it by the applicable laws and regulations and which are in the public interest.

The Client may submit a request for the exercise of his rights:

• by e-mail, signed by a secure electronic signature;
• by authorizing on BeeTech Services website .

Upon receiving the Client's request for the exercise of its rights, BeeTech Services verifies the Client's identity, evaluates the request and executes it in accordance with regulatory enactments.

The BeeTech Services response is sent to the Client by e-mail to the address indicated by the Client.

BeeTech Services ensures fulfillment of data processing and protection requirements in accordance with regulatory enactments and, in case of Client's objections, performs useful actions to resolve the complaint. However, if this fails, the Client has the right to contact the Supervisory Authority - the Data State Inspectorate.

Client's consent to data processing and the right to withdraw it

Client’s consent to the processing of personal data, the legal basis of which is consent (for example, service usage data analysis, individually prepared advertisements, etc.) may be obtained through the authorization in the BeeTech Services application, on the BeeTech Services web pages (for example, newsletter sign-up forms).

The Client has the right at any time to withdraw the consent for data processing in the same manner as it was provided, in which case further processing of the data based on the prior consent for the particular purpose will not be carried out in the future.

The withdrawal of consent does not affect the processing performed at the time when the Client's consent was valid.

With the withdrawal of consent, data processing, which is done on other legal grounds, cannot be stopped.

Communication with the Client

BeeTech Services communicates with the Client using the Client's contact information (e-mail address, on the BeeTech Services website, as well as using application notifications).

Commercial announcements

Commercial communication for BeeTech Services and / or third party services and other non-direct communications related to the provision of contracted services (such as customer surveys) BeeTech Services performs in accordance with external regulatory enactments or with the consent of the Client.

BeeTech Services can also use for communication automatic systems.

Client consent to receive commercial communications from BeeTech Services and / or its partners can be given by filling out BeeTech Services application forms, through BeeTech Services applications and BeeTech Services websites (such as newsletter sign-up forms).

Client's consent to receive commercial communications is valid until its withdrawal (also after the termination of the service contract). The Client may at any time refuse to receive further commercial communications in any of the following ways:

• on their user profile in BeeTech Services app;
• sending an email to info@beeking.eu;
• changing the settings for notifications on devices;
• using the automated opportunity provided for in the commercial communication to opt out of receiving further notices by clicking on the opt-out link at the end of the relevant commercial communication (e-mail).

BeeTech Services stops sending commercial notifications as soon as Client's request is processed. Demand processing depends on technological capabilities, and can take up to seven days.

When expressing your opinion in the surveys and leaving your contact information (e-mail, telephone), the Client agrees that BeeTech Services may contact him regarding the evaluation provided by the Client, using the Client's contact information.

Website visits and cookie processing

BeeTech Services websites can use cookies. The cookie handling policy is available in the "BeeTech Services Cookie Policy".

BeeTech Services websites may have links to third-party websites that have their own usage and personal data protection rules, which BeeTech Services is not responsible for.

BeeTech Services has the right to make additions to the Privacy Policy. Latest version is provided to the Clients in their user profile section of BeeTech Services app, as well as on the BeeTech Services website.

BeeTech Services retains the previous versions of the Privacy Policy.

This Privacy Policy enters into force on the 20 May 2018.
